Record crowd of pathologists and clinical laboratory managers hear from medical lab industry leaders
Dateline: New Orleans, Louisiana—Here at the 16th annual Executive War College (EWC) on laboratory and pathology management, a crowd of record size has gathered to learn the latest trends in the clinical laboratory testing marketplace, and to hear about innovations and new management breakthroughs, as shared by top-performing medical laboratories.
As your Dark Daily editor, this is my first EWC. Readers of Dark Daily’s ebriefings (darkdaily.com) know me from my articles on the website. I’ve learned much about clinical laboratories and anatomic pathology groups since joining The Dark Group last year. And though my editorial background includes a recent six-year stint as Editor of Health Management Technology magazine, I was nevertheless impressed by the depth of information being offered at EWC. It is why this is truly the “must attend” conference for lab managers and pathologists.

CMS says it will take steps to rescind the final rule before its scheduled implementation on April 1, 2011
Clinical laboratories and pathology groups will welcome the news that the federal Centers for Medicare & Medicaid Services (CMS) will take steps to rescind the final rule that requires the physician’s signature be on all paper requisitions for medical laboratory tests ordered on behalf of Medicare patients. It means that implementation of the rule—now scheduled to become effective on April 1, 2011—will not happen if CMS officials act in a timely manner.
Dark Daily has learned that last Friday a conference call took place involving Jonathan Blum, Director of the Center for Medicare Management, and representatives from the American Association of Bioanalysts (AAB) and the American Clinical Laboratory Association (ACLA). During the conference call, Blum disclosed that a decision had been reached within CMS to rescind the final rule that would require physicians’ signatures on paper requisitions for medical laboratory tests. Apparently, CMS intends to take the steps necessary to rescind this final rule before its effective date of April 1, 2011.

Following an agreement by federal attorneys to destroy the lab bidder’s documents, a federal judge dismisses the case
Last month in a San Diego courtroom, federal attorneys agreed to destroy the clinical pathology laboratory bid documents that had been submitted as part of the poorly-conceived Medicare Part B Laboratory Competitive Bidding Demonstration Project that the Centers for Medicare and Medicaid (CMS) attempted to implement in 2008.
An agreement to destroy the bid documents was negotiated agreement between attorneys for the plaintiff clinical laboratories and federal attorneys for the Department of Health and Human Services (HHS).

But ACLA’s Alan Mertz says clinical pathology test volume may increase because of other elements of this comprehensive makeover of the nation’s health system
Two provisions in the new healthcare legislation signed into law on March 23 by President Obama will have a direct effect on clinical laboratories, said Alan Mertz, President of the American Clinical Laboratory Association (ACLA). One provision is an across-the-board 1.75% cut to the clinical lab fee schedule in each of the next five years, effective in 2011.
The second provision directly impacting clinical laboratories is called the productivity adjustment and may also lead to a drop in the annual update for clinical laboratory testing. However, Mertz believes that other provisions in the act may prove positive for clinical labs in the coming years. Mertz made these remarks during a conference call late last month.

Ex-Senate Majority Leader Predicts Democrats Will Aggressively Push Reform
In recent weeks, laboratory professionals got a ringside seat to hear a true Washington insider discuss key issues in healthcare reform. Former U.S. Senate Majority Leader Tom Daschle, told lab industry executives and pathologists that Congress faces three significant hurdles as it attempts to reform the healthcare system. The first—and perhaps most significant—hurdle involves costs, he said. Daschle is currently a Senior Policy Advisor at Alston and Bird, a law firm in Washington, D.C.
“Cost is a huge political factor,” stated Daschle during a recent audio conference conducted by the American Clinical Laboratory Association (ACLA) on June 24. “Of all of the factors, cost is driving this debate as much if not more than any [other single factor]. We are looking at an investment cost of about $1 trillion to put this new infrastructure in place and that is an issue of great concern.” Daschle explained that the other two hurdles are quality of care and access to healthcare.
